eSign Consent to use Electronic Records and Signatures

Your agreement to this consent form indicates you wish to receive and sign the documents relating to your transactions with us electronically.

You are entitled to paper copies of certain information and we need your consent to provide you with this information electronically. We also need your general consent to use electronic records and signatures in our relationship with you.

By applying for this account you agree to be enrolled to receive Paperless Statements rather than paper statements through the mail. Listed below are some additional communications you may receive:

Account Terms and Conditions and disclosures related to opening an account;

Any disclosure or notification that is required under applicable laws and regulations. This may include, but is not limited to, a change-in-terms notice, information about any dispute you might raise under the Electronic Funds Transfer or Truth in Lending Acts. Also, annual notices are required under the Electronic Fund Transfer Act and the Privacy Policy;

  • Our Privacy Policy;
  • Year-end tax information;
  • Any other disclosures that we are required to provide; or
  • Any other communication we may provide to you

In this Consent, the words “we” “us” and “our” means Black Opal Inc. The words “you” and “your” means the person giving consent. “Communications” means the following disclosures. Disclosure, notice, agreement, undertaking, fee schedule, billing statement, promotion, offer, record, document, or other information we provide to you.

1. Your Consent.

You agree that any of the Communications we provide to you, or that you sign or agree to, maybe in electronic form. Your Consent will apply to this transaction and all documents related to this transaction. We may also use electronic signatures and obtain them from you on any Communication.

Each Communication that we provide to you in electronic form will be delivered either.

(1) by your accessing an online location we designate or

(2) via e-mail. As a courtesy, we may send you an e-mail, text message, push notification, or other electronic notice when the Communication is available. The Communication will be available at the designated online location regardless of whether or not we send such notice.

Sometimes the law, or our agreement with you, requires you to give us written notice. You must still provide these notices to us on paper unless we tell you how to deliver the notice to us.

2. How to Withdraw Consent.

You may withdraw your consent to receive Communications electronically at any time, without penalty. 

Contact us at the number on the back of your card, or through your online account on our website. Withdrawing your consent may delay your transactions with us.

In addition, we may offer a discount, now or in the future, for conducting business electronically.  A withdrawal of consent could result in the removal of any such discount.

3. How to Update Your Contact Information.

It is your responsibility to provide us with an accurate and complete e-mail address and other contact information.  You to promptly maintain and update any change in this information. You can update your contact information at any time by contacting us at the number on the back of your card, or through your online account on our website.

4. Hardware and Software Requirements.

To receive electronic Communications, you must have access to:

  • A Current Version (defined below) of an Internet browser such as Chrome, Safari, or Edge;
  • A connection to the Internet;
  • A Current Version of a program that accurately reads and displays PDF files; and
  • A computer and an operating system capable of supporting all of the above. You will also need a printer if you wish to print out and retain records on paper, and electronic storage if you wish to retain records in electronic form.

From time to time, we may offer services or features that require your Internet browser to be configured in a particular way.  If we detect that your Internet browser is not properly configured, we will provide you with a notice.

We may also require you to use a Current Version of one or more specific software applications we may specify from time to time. We reserve the right to discontinue support of a Current Version of any software if in our sole opinion, it suffers from a security flaw or other flaw that makes it unsuitable for use or if our hardware or software requirements change.

Continuing to use this service after receiving notice of the change is a reaffirmation of your consent.

5. Requesting Paper Copies.

We may not send you a paper copy of electronic communications from us unless you request it or we otherwise deem it appropriate to do so. You can obtain a paper copy of certain Communications we provide to you electronically by printing it yourself or by requesting that we mail you a paper copy.

Requests for paper copies must be made within a reasonable time after we first provided the electronic Communication to you. To request a paper copy, contact us at the number on the back of your card, or through your online account on your website.

6. Retaining copies.

We encourage you to print or download a copy of all your electronic Communications.  Including, as well, this ESIGN Consent disclosure and any other documents that are important to you.

7. Termination/Changes.

In our sole discretion, we reserve the right to discontinue the provision of your electronic Communications. Or terminate or change the terms and conditions on which we provide electronic Communications. We will provide you with notice of any such termination or change as required by law.

By giving your consent, you are also confirming that you have the hardware and software described above.  You are able to receive and review electronic records, and that you have an active email account and the ability to access PDF files.
